    USA Probate in the UK

    There are a number of similarities between the US probate process and the UK, in so far as the terminology is largely similar with Executors appointed to administer estates while the US Courts issue a Letters of Testamentary which is very similar to the Grant of probate document issued in the UK.

    Unfortunately, US probate cannot be resealed in the UK, this means that to release assets in the UK a new application will need to be made in the UK. Typically, when making the application for probate in the uk, an affidavit of law signed by a US attorney will be required which sets out the legal process that has been followed in the US state Court. As a result of this, to obtain probate in the UK, we would require the sealed and certified court papers issued in the US ( the letters of testamentary and will ), death certificate and details of the UK assets to be collected.
