Often when wills are contested the estate administration is often put on hold until the dispute is resolved.
If you are an executor and are unhappy with a will, then it is important that you either renounce probate or let another executor named in the will administer the estate otherwise there is a risk, that your role as an executor could be compromised as it is unlikley you would want to probate a will that you are unahppy with. Typically, an independent solicitor is often best placed to obtain probate. In certain cases, for example when there is a property in an estate, an independent solicitor ( subject to the parties agreement ) can obtain what is a called a limited grant – this enables the estate assets to be collected ( for example the sale of a property ) but not distributed until the dispute has been resolved.
It is important that you always seek advice if you are an executor of a will, otherwise there is always the risk that a beneficiary could apply to the Court to have you removed as an Executor on the grounds that you are not acting in the best interests of the estate.
