Very often we are contacted by Executors or family relatives, who ask us whether they still need probate if the Deceased left a will – the short answer very much depends upon what assets the Deceased owned in their own name.
If the Deceased left a property, cash in a bank above £15,000, shares worth more than £15,000, then you will need probate even if there is a will. The reason for probate is that once the Court proves the will, and issues the Executor with a grant of probate, this is the legal document confirming the Courts authority that the will, was the deceased’s final will and testament and confirmation that the estate can be administered.
