As a firm specialising in probate we often get asked about the probate process, what does it involve and how long does it take ?
The probate process typically has four key stages, firstly accessing the Deceased persons estate and how their will is to be administered. For example, is there a will or did the Deceased die intestate without a will ( click here for the Intestacy Rules. The Second stage, is applying for probate this involves the actual application to the Probate Registry which requires the completion of an Inheritance Tax return, as well as the Oath. This sets out the basis of the applicant. the Third stage is collecting in the assets from the bank, or sale of property etc, while the fourth part involves the distribution of the estate.
