As a firm specialising in international probate, we regularly handle reseal applications and those cases in which the Deceased may have died outside the UK, but still held assets in England. One frequently asked question relates to whether probate in Ireland can be used to collect UK assets, in short the answer is no. Banks and other financial institutions will not accept the Irish Grant while a Reseal Application is not permitted as Ireland is not a country recognised under the UK Colonial Probates Act. Instead this means that a new application in the UK must be made seeking an Order from the UK probate registry that probate should be granted to the Executor or Administrator to whom probate has been issued in Ireland. We regularly help Irish Solicitors and Administrators to with probate in the UK.
