What is a Power of Attorney ?
A Lasting Power Of Attorney is a legal document which will allow the person or people you name in it to take care of all matters for you when you are incapacitated, either temporarily or in the long term. This can include :-

- Avoiding the unnecessary delay and costs of involving the Court Of Protection
How a Power of attorney works
There is a standard application process for a lasting power of attorney. The form requests various information relating to the Donor ( the person making the LPA ) as well as the persons whom the Donor would like to appoint as their attorney’s.
One important feature on the form is a certificate provider, this is a section that must be completed by either a solicitor or someone that has known the Donor for two years or more and can certify that the Donor has the requisite mental capacity to make the Power of Attorney.
The Certificate provider is typically a solicitor, and we have a dedicated team experienced at working with clients who have suffered health problems such as a heart attack, Parkinson’s, or Alzheimers. Alternatively, the certificate can be signed by someone who has known the Donor for two years or more, but must not be a member of their family, or someone closely connected eg. employer or business partner.
