A Power of attorney is a legal document that enables others to act on your behalf if you lose the capacity to act in regard to either your financial or personal affairs.
A power of attorney is most commonly known as a Lasting Power of Attorney (LPA). The process to obtain a LPA is via a registration process to the Office of the Public Guardian which regulates the issue of LPA’s which can be made in two forms, Property and financial affairs enabling the management of financial affairs of the person making the LPA, and secondly the LPA governing Health and welfare. In both cases the donor has to have the mental capacity to make the LPA in accordance with the Mental Capacity Act.
