As a firm specialising in probate, we are frequently asked by family members as to whether they have to use the solicitor holding the will when applying for probate ? The simple answer is No. Unless the will appoints the solicitor as an executor.
If you are the Executor you are entirely free to use whoever they would like for the probate process. A lot of local solicitors will still charge hourly rates and percentages of estates however the feedback from our clients, is that they simply want probate undertaken on a simple to understand fixed fee basis. As a result of this we guarantee that we will always be able to quote a fixed fee for the work to be undertaken. Typically, we simply need to know a few basic questions such as the size of the estate, and the beneficiaries under the will.
Often there is a degree of embarassment at changing solicitors and given this our approach is always simply to obtain a letter of authority from the executor enabling us to obtain the will from the solicitors firm.
